That's messed up. A band just asked me the other day if they could perform a cover to a Slayer song at a upcoming national show, but now I guess the answer is no... that's gay.

i was under the assumption that playing covers live can be done anytime, it's recording and selling them that is the issue

i don't think anyone else would act on that though, those guys are probably just a bunch of douchebags looking for an easy paycheck

I'm pretty sure as long as the bands weren't paid per song, than there's no suit and even if there were, it should be against the bands.

if this was a legitimate suit then every cover/tribute band in america would have to stop playing out immediately, which si another point. don't you think every cover/tribute band would've had to deal wtih this already?

The bar has to pay an ascap or BMI fee (royalty) fee every year or the cover bands can't play at the club, or original bands that might do a cover.

Right, which is at most 7 cents per song, although that's often capped off at 5.5 cents per song (assuming the figures haven't changed in the nine years since I read this )

the BMI/ASCAP fee is like $7K/year and you are suppose to keep at log of all the songs.
or give a couple times per year sample that they then extrapolate.
