Police say John Mulloy, 27, of Braintree, stabbed Edward Tucci, 52, of Weymouth, outside Tucci’s 18 Carroll St. home late Friday night. An argument began earlier in the night, family members said, when Mulloy, the boyfriend of Tucci’s daughter, arrived uninvited and intoxicated to the gathering. He was asked to leave, and did so, several times before returning just before midnight, when Tucci was stabbed, they said. Tucci was rushed to Boston Medical Center for emergency surgery. His father, Charles Tucci of Weymouth, said his son has been on a respirator since Saturday. Mulloy pleaded innocent to charges of armed assault with intent to murder and assault and battery with a dangerous weapon Monday in Quincy District Court. He claimed self-defense when police arrested him and again in court, saying that Tucci had attacked him. But the “complete lack” of defensive wounds and the fact that the stabbing took place at the victim’s home do not support a claim of self-defense, Weymouth Police Sgt. Rick Fuller said. Officers examined Mulloy when they arrested him and found no injuries, he said. “It’s usually impossible to defend yourself without getting at least nicked,” Fuller said. “Add to that the fact that he was at (Tucci’s) house and was repeatedly told he was not wanted, and that makes self-defense hard to believe.” Mulloy was dating Tucci’s daughter, Emily. “This was a case of a father protecting his daughter,” Charles Tucci said. Police say Mulloy had been to the Tucci home three times that night before the stabbing and was told to leave each time. One of the times, he allegedly took what Emily Tucci described as a 10-inch knife from her father’s knife collection. When Mulloy returned a fourth time, police say Tucci confronted him in the yard, where Mulloy stabbed him three times, including once in the neck. Emily Tucci called police, who arrived on the scene and later found Mulloy at the home of a friend at 199 Middle St. Charles Tucci said he offered Mulloy, who had been drinking, a ride home earlier in the evening, but Mulloy refused. “If he had just gotten in my car and gone home, this never would have happened,” Tucci said. “Instead, he’s in jail and my son’s in the hospital with a tube down his throat.” Two small children were in the house, one Emily Tucci’s and one John Mulloy’s. The pair has no children together. A spokesman for the Department of Social Services confirmed that the agency had visited the home and that both children remained with the parents who had previous custody. Mulloy’s bail was set at $30,000, but he is being held for violating probation in three prior convictions between September 2006 and August 2007. The convictions were for heroin possession, negligent operation of a vehicle and larceny from a building. “He’s not taking it seriously, you can tell,” said police prosecutor Steven Gomez. “With his record and the seriousness of this crime, he should be.” and yes, that is me commenting on the site under Weymouth Rock ya think they mean Jay Severin is the asian lover?[/QUOTE]
